劳动者辞职注意事项
一、辞职是法律赋予劳动者的绝对权
1、试用期内，提前三日，可口头通知。
应注意保存好已经通知用人单位的相关证据，可适当录音或者提供人证。
2、试用期已过或没有约定试用期的，提前三十日，并且只能以书面形式通知。应注意《辞职单》等应让用人单位签收，自己复印一份；如果用人单位不签收，可通过快递或挂号信形式发出，并且快递或挂号信要体现辞职的相关信息。
3、只需提前通知，无需征得用人单位同意。
用人单位以公司订单多、招不到人、合同期未满等为由不同意、不批准劳动者辞职是不符合法律规定的，因为辞职是劳动者拥有的绝对权利，而非相对权。劳动者依法定程序向用人单位提出辞职后，届时要求用人单位办理离职手续的，用人单位应配合办理。
二、辞职理由要据实填写
1、辞职理由决定——能否立即解除劳动合同
如果用人单位有未及时足额支付劳动报酬、未依法为劳动者缴纳社会保险费以及以暴力、威胁或者非法限制人身自由的手段强迫劳动等《劳动合同法》第三十八条规定情形的'，劳动者可以立即解除劳动合同，不需提前通知用人单位。如果劳动者在辞职理由上填写的是“回老家”或者“个人原因”等，则需提前三日或者三十日通知用人单位才可解除。
2、辞职理由决定——能否获得经济补偿或赔偿
劳动者符合《劳动合同法》第四十六条规定、第八十七条规定，可以要求用人单位支付经济补偿金或者赔偿金。经济补偿按劳动者在本单位已经工作的年限，每满一年支付一个月工资的标准向劳动者支付，赔偿金是补偿金的二倍。但是如果辞职理由写的是“回老家”或者“个人原因”等的，之后再向劳动仲裁委或法院要求用人单位支付经济补偿金或赔偿金的，一般不会得到支持。
三、劳动者未按法律规定离职要承担赔偿责任
劳动者违反《劳动合同法》规定，未提前三日或未提前三十日通知用人单位，要求用人单位解除劳动合同、办理相关离职手续的，用人单位可以不予办理。劳动者违法解除劳动合同而给用人单位造成经济损失的，应当依据有关法律、法规、规章的规定和劳动合同的约定承担相应赔偿责任。
